Welcome to Plumberai.io ("Service"), a product of Clobix Technologies LLC ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Plumberai.io website, applications, and services.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. Description of Service

Plumberai.io provides an AI-powered virtual receptionist service for plumbing businesses. Our service includes:

AI-powered phone answering for incoming calls
Lead capture and management
SMS and email notifications
Website hosting for plumbing businesses
Work order management (with add-on subscription)
Payment processing (with add-on subscription)

3. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that:

You are at least 18 years of age
You have the authority to enter into these Terms
You are a plumbing business owner or authorized representative
You will comply with all applicable laws and regulations
All information you provide is accurate and complete

4. Account Registration

4.1 Account Creation

To use the Service, you must create an account. You agree to:

Provide accurate, current, and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access
Accept responsibility for all activities under your account

4.2 Account Types

We offer multiple subscription tiers:

4.3 Account Suspension

We reserve the right to suspend or terminate your account if you:

Violate these Terms
Engage in fraudulent activity
Fail to pay fees when due
Use the Service for illegal purposes

5. Payment Terms

5.1 Fees

You agree to pay all fees associated with your subscription tier and any add-ons:

Subscription Tiers:

Free: $0 (limited usage)
Pro: $99/month
Power: $149/month

Add-ons:

Basic Website: $20/month
3-Page Website: $40/month
Premium Template: $60/month
Work Orders: $100/month
Payments: $50/month
Customer CRM: $30/month
SMS Marketing: $40/month
Additional Users: $15/user/month

5.2 Billing

Billing occurs monthly on your subscription anniversary date
Payments processed through our secure payment processor
You authorize us to charge your payment method on file
All fees are non-refundable except as required by law

5.3 Overage Charges

Exceeding your plan's minute limit results in overage charges:

$0.50 per minute for Pro and Power tiers
Charged automatically to your payment method
Usage resets on the 1st of each month

5.4 Price Changes

We may modify pricing with 30 days' notice. Continued use after changes constitutes acceptance.

6. Service Usage

6.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

Use the Service for any illegal purpose
Attempt to gain unauthorized access to our systems
Interfere with other users' access to the Service
Transmit viruses, malware, or harmful code
Use the Service to harass, abuse, or harm others
Attempt to reverse engineer our AI or systems
Resell or sublicense the Service without authorization
Use the Service in violation of TCPA or other telemarketing laws

6.2 Call Recording

By using our Service, you acknowledge that:

Calls may be recorded for quality and training purposes
You are responsible for complying with call recording laws in your jurisdiction
You must inform callers that calls may be recorded if required by law
Recordings are stored for 90 days unless otherwise specified

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Clobix Technologies LLC and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for your business purposes.

8. Limitation of Liability

IN NO EVENT SHALL CLOBIX TECHNOLOGIES LLC BE LIABLE FOR:

Indirect, incidental, special, or consequential damages

Lost profits or revenue

Loss of business or business opportunity

Loss of data

Damages exceeding the amount you paid to us in the 12 months preceding the claim

OUR TOTAL LIABILITY SHALL NOT EXCEED: $500 or the amount you paid us in the 12 months before the claim, whichever is greater.

9. SMS Terms

9.1 SMS Service

By providing your mobile number, you consent to receive SMS messages from Clobix Technologies LLC (PlumberAI.io) regarding new lead notifications (caller name, phone number, address, and service request details captured by your AI receptionist). Consent to receive SMS messages is not required to purchase any goods or services.

9.2 Message Frequency

Message frequency varies based on incoming call volume. You may receive 0–50+ messages per day.

9.3 Opt-Out

You may opt out at any time by:

Replying "STOP" to any message
Emailing support@Plumberai.io
Updating notification preferences

9.4 Help

For help, reply "HELP" or contact support@Plumberai.io.

9.5 Message and Data Rates

Standard message and data rates may apply from your carrier.

10. Termination

10.1 By You

You may cancel your subscription at any time:

Cancel through your account settings
Contact support@Plumberai.io
Service continues until end of billing period

10.2 By Us

We may terminate or suspend your account immediately if you:

Violate these Terms
Engage in fraudulent activity
Fail to pay fees
Use the Service illegally

11. Dispute Resolution

11.1 Mandatory Arbitration

ANY DISPUTE ARISING FROM THESE TERMS OR THE SERVICE SHALL BE RESOLVED THROUGH BINDING ARBITRATION administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.

11.2 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS.

11.3 Exceptions to Arbitration

Arbitration does not apply to:

Small claims court actions
Intellectual property disputes
Claims for injunctive relief

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Louisiana, United States, without regard to conflict of law principles.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

Posting the updated Terms on our website
Sending an email notification
Displaying a notice in your account

Your continued use after changes constitutes acceptance.
